Terms of Service

1. Overview

BrightSide Painters is a professional painting company providing residential and commercial painting services across New Zealand. These Terms of Service apply to all customers who request a quote, make a booking, or engage BrightSide Painters to carry out work.

By accepting a quote or confirming a booking with us, you agree to these terms. If you have any questions before proceeding, please contact us - we're happy to clarify anything.

These terms do not affect any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

2. Services

BrightSide Painters provides interior painting, exterior painting, commercial painting, and related preparation and finishing work. The specific scope of work for each job is set out in the quote we provide to you before any work begins.

All quotes are based on an assessment of the property and the information you provide. Quotes are estimates of the expected cost and are valid for 30 days from the date of issue. If site conditions differ materially from what was assessed - for example, additional surface preparation is required, or the area to be painted is larger than originally understood - we will notify you before proceeding and provide a revised quote.

We reserve the right to decline or discontinue work if we identify conditions that make it unsafe or impractical to complete the job as scoped.

3. Bookings and Scheduling

A booking is confirmed once you have accepted our quote in writing (including by email or through our online booking form) and any required deposit has been received.

We will agree on a start date and estimated duration with you at the time of booking. While we make every effort to stick to the agreed schedule, delays can occur due to weather (particularly for exterior work), unforeseen site conditions, or factors outside our control. We will keep you informed of any changes as early as possible.

Cancellations: If you need to cancel or reschedule your booking, please give us at least 48 hours' notice. Cancellations with less than 48 hours' notice may result in a cancellation fee to cover any materials purchased or time set aside for your job. We will notify you of any applicable fee before charging it.

If we need to reschedule due to circumstances on our end, we will contact you as soon as possible and arrange an alternative date at no extra cost to you.

4. Payment Terms

For most jobs, we require a deposit before work begins. The deposit amount will be stated in your quote and is typically 20–30% of the total job value. This helps cover the cost of materials purchased specifically for your project.

The remaining balance is due on completion of the work, unless otherwise agreed in writing. An invoice will be issued on or after the final day of work.

Payment is accepted by bank transfer or as otherwise indicated on your invoice. Payment must be received within 7 days of the invoice date, unless a different arrangement has been agreed in writing.

If payment is not received by the due date, we reserve the right to charge interest on the overdue amount at the rate of 2% per month, and to pursue recovery of the debt through appropriate channels.

5. Workmanship Warranty

We stand behind our work. If you notice a defect in our workmanship within 12 months of job completion - such as peeling, flaking, or uneven coverage that is not caused by normal wear, weather exposure beyond typical conditions, or damage after our crew left site - please contact us and we will assess the issue and carry out any necessary touch-ups at no charge.

This warranty applies to defects in workmanship only. It does not cover:

  • Normal wear and tear over time
  • Damage caused by impact, moisture intrusion, or structural movement
  • Colour fading due to prolonged UV exposure
  • Areas that were repainted or altered by a third party after our work was completed
  • Issues arising from a substrate condition you were informed about in writing prior to work commencing

The paint manufacturer's warranty applies separately to the products used. We are happy to provide product details on request.

6. Liability

BrightSide Painters carries public liability insurance for work carried out on your property. If you would like to confirm our current coverage, please ask and we will provide details.

To the extent permitted by law, our total liability to you in connection with any job is limited to the amount paid by you for that job. We are not liable for any indirect or consequential loss, including loss of income or loss of use of your property.

We take reasonable care when working on your property, but we are not responsible for pre-existing damage or defects to surfaces, structures, or fittings that are not related to our work.

If you believe our work has caused damage to your property, please notify us within 14 days of the damage occurring so we can investigate promptly.

7. Your Responsibilities

To allow us to carry out work safely and efficiently, we ask that you:

  • Provide safe and reasonable access to the areas to be painted on the agreed start date and throughout the job
  • Remove or relocate any fragile, valuable, or irreplaceable items from the work area before our crew arrives - while we take care with your belongings, we cannot accept liability for items left in work areas
  • Ensure pets and children are kept clear of the work area during painting and while surfaces are drying
  • Confirm and sign off on all colour choices before work begins - once a colour has been applied, changes will be treated as additional work and quoted accordingly
  • Notify us of any known hazards on the property, such as asbestos, lead paint, or unstable structures

If we are unable to access the property or complete work due to circumstances within your control, we may charge for any time or costs incurred as a result.

8. Changes and Cancellations

If you wish to change the scope of work after a booking has been confirmed - for example, adding rooms, changing colours after work has started, or expanding the area to be painted - please let us know as soon as possible.

Changes to scope may affect both the price and the timeline. We will provide a revised quote for any additional work before proceeding. We will not carry out additional work without your approval.

Where a change reduces the scope of work, any reduction in price will be calculated based on the costs already incurred at the time the change is requested.

9. Disputes

If you are unhappy with any aspect of our work or service, please contact us directly in the first instance. Most concerns can be resolved quickly, and we take all feedback seriously.

If a dispute cannot be resolved through direct discussion, both parties agree to attempt to resolve it through mediation before pursuing any formal legal action. The cost of mediation will be shared equally unless otherwise agreed.

These terms are governed by the laws of New Zealand. Any legal proceedings must be brought in a New Zealand court of competent jurisdiction.
